EXPLANATION OF EXEMPTIONS
SUBSECTIONS OF TITLE 5, UNITED STATES CODE, SECTION 552
(b) (1 ) (A) specifically authorized under cri\eria established by an Executive order to be kept secret in the interest of national defense or
foreign policy and (B) are in fact properly classified pursuant to such Executive order;
(b) (2) related solely to the internal personnel rules and practices of an agency;
(b) (3) specifically exempted from disclosure by statute (other than section 552b of this title), provided that such statute (A) requires that
the matters be withheld from the public in such a manner as to leave no discretion on the issue, or (B) establishes particular criteria for
withholding or refers to particular types of matters to be withheld;
(b) (4) trade secrets and commercial or financial information obtained from a person and privileged or confidential;
(b) (5) inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation
with the agency;
(b) (6) personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy;
(b) (7) records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement
records or information (A) could reasonably be expected to interfere with enforcement proceedings. (B) would deprive a person of a right
to a fair trial or an impartial adjudication, (C) could reasonably be expected to constitute an unwarranted invasion of personal privacy,
(D) could reasonably be expected to disclose the identity ol a confidential source, including a State, local, or foreign agency or authority
or any private institution which furnished information on a confidential basis, and, in the case of record or information compiled by
a criminal law enforcement authority in the course of a criminal investigation, or by an agency conducting a lawful national security
intelligence investigation, information furnished by a confidential source, (E) would disclose techniques and procedures for law enforce-
ment investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure
could reasonably be expected to risk circumvention of the law, or’(F) could reasonably be expected to endanger the life or physical
safety of any individual;
(b) (8) contained in or related to examination, operating, or condition reports prepared by, on behall of. or tor the use of an agency responsible
for the regulation or supervision pf financial institutions; or
(b) (9) geological and geophysical information and data, including maps, concerning welts.

privilege under Federal programs, or which would identify a source who furnished information pursuant to a promise that his/her identity
would be held in confidence;
(k) (3) materia! maintained in connection with providing protective services to the President of the United States or any other individual pursuant
lo the authority of Title 18, United States Code, Section 3056;
(k) (4) required by statute to be maintained and used solely as statistical records;
(k) (5) investigatory material compiled solely for the purpose of determining suitability, eligibility, or qualifications for Federal civilian employment
or for access to classified information, the disclosure of which would reveal the identity of the person who furnished information pursuant
to a promise that his/her identity would be held in confidence;
(k) (6) testing or examination material used to determine individual qualifications for appointment or promotion in Federal Government service
the release of which would compromise the testing or examination process;
(k) (7) material used to determine potential for promotion in the armed services, the disclosure of which would reveal the identity of the person
who furnished the material pursuant to a promise that his/her identity would be held in confidence.

Joseph Frederick Doherty was the subject of an
applicant-type investigation covering his adult life
for the purpose of the Department of Justice granting
him a "Top Secret” clearance, since he has a need for
access to classified FBI information. Doherty is
Director of Corporate Security for the Atlantic w
Telephone and Telegraph, Basking Ridge, New Jersey*. (€)
Doherty’s birth on May 26, 1922, at New York,
New York, was verified through the New York City
Department of Health, Manhattan, New York,
Doherty attended Fordham University, New York,
New York, from September, 1941, through January 24, 1943,
and also from January 29, 1946, including the summer
of 1946. Doherty majored in liberal arts and was a
full-time student. His overall average and class
standing was not indicated. Doherty received no
degree, but left the university in good standing.
Doherty attended New York University, School of Law,
New York, New York, from September, 1946, to June, 1948,
also including the summer of 1947 and the summer of 1948.
Doherty’s overall average was 75.0 and his class standing
was 22 out of 86. He made the Dean's List in

degree on October 11, 1948* Doherty also attended
Columbia University, New York, New York, from
September, 1953, through June, 1955, with no summers.
Doherty also attended the university from September,
1956, through June, 1958, with no summers. Doherty
obtained a Master of Business Administration degree
on June 2, 1958. ($)
Doherty enlisted in the U.S. Air Force , on
February 27, 1943, and served through March 1, 1946, as
a flight officer. There was nothing to indicate any
derogatory information concerning Doherty.
Doherty received a "Top Secret" security
clearance on October 9, 1965, based upon a background
investigation by the U.S. Air Force dated May 28, 1959*
This clearance was terminated on June 29, 1978, and the
employing agency was the Atlantic Telephone and Telegraph,
Basking Ridge, New Jersey.
Doherty received a r Top Secret" security
clearance on October 9, 1965, based upon a background
investigation by the U.S. Air Force dated May 28, 1959.
This clearance is active and the employing agency is the
Atlantic Telephone and Telegraph, Bedminster,

Doherty was afforded a T Top Secret* security
clearance on February 28, 1949. based upon a full-field
background investigation conducted by the FBI . Doherty
was a Special Agent from February 28, 1949, until
March 3i, 1954, at which time his "Top Secret" clearance
was terminated .
All references and associates contacted highly
recommended Doherty for a position of trust and confidence
with the U.S. Government.
Doherty's employments have been verified and
were favorable.

School of Law, New York University, Washington Square,
New York City, was contacted and advised the applicant
attended above university from September, 1946 to June,
1948, also including the summer of 1947 and the summer
of 1948, She advised the applicant majored in law and
was a day full-time student. The applicant's overall' average
was 75.0 and class standing was 22 out of 86. She advised
the applicant made the dean’s list in September of 1948,
she further advised no employment was reflected and no
failures were reflected. She could. suggest no one who
would recall the applicant due to the lapse. of time and
changes in the university staff. She advised that the
applicant obtained a LLB degree on October 11, 1948.
On May 9, 1980XKATHELEEN O'DONNELL, Manager,
Transcripts and Inquiries, Columbia University, 11 6th Street
and Broadway, New York City, was contacted and advised
the applicant attended the above university from September,
1953 through June, 1955, with no summers included. She
advised that the applicant registered for the fall of 1955
but. withdrew on October 27, 1955 with no further information

This information is provided pursuant to Public Law 93-579 (Privacy Act of 1974), December 31,
1974, for individuals supplying information for inclusion in a system of records.
AUTHORITY
Title 28, Code of Federal Regulations, Section 0.137, authorizes the Director of the FBI to exercise ,
power and authority vested in the Attorney General by law to take final action in matters
pertaining to the employment, direction and general administration of personnel in the FBI*
PURPOSES AND USES
The information you supply will be used along with data you supplied previously and information
developed by investigation to determine your fitness for employment, continued employment, or
promotional opportunity in the Federal Bureau of Investigation (FBI) or for other employment
purposes, including a security clearance and an evaluation of qualifications, suitability, and loyalty
to the United States. This information may be furnished to designated officers and employees of
agencies and departments of the Federal Government for employment purposes, including a
security clearance determination, an access determination, an evaluation of qualifications,
suitability, loyalty to the U. S. Government, and a determination regarding qualifications or
suitability for performing a contractual service to the Federal Government. The information may
also be disclosed to any agency of the Federal Government having a working relationship with
regard to FBI activities, to the intelligence agencies of the Federal Government, or to others
having reasons as published in the Federal Register.
EFFECTS OF NONDISCLOSURE
You are not required to answer to questions you will be asked; however, if you do not answer them,
the FBI will evaluate your case on the basis of information at hand without your explanation.
Failure to respond to a question could result in your being rated ineligible for employment,
continued employment, or promotional opportunity by the FBI. A false answer to any question on a

entitled, "Communication Common-Carrier Employee Termination
Agreements."
Since the below-listed common-carrier employees have
retired and will not require a "Top Secret" security clearance,
the DOJ Security Officer has requested that these individuals
be afforded a debriefing.
Newark: Contact each of the above-named common- carrier
employees and afford them a debriefing. This debriefing is the
process of informing them that their access to classified information
has been withdrawn but that he/she is still bound by certain
security regulations pertaining thereto. Each common-carrier
employee’s are to complete the attached termination agreement
and upon completion, these forms are to be returned to FBIHQ,
Security Programs Unit, Room 5432, as soon as possible.
